The recent order of Hon’ble Supreme court in Unitech case
UPON hearing the counsel the Court made the following
O R D E R
Let the matter be listed on 21.09.2017 to enable
Mr.Pawan Shree Agarwal, learned amicus curiae, to file a chart of
all projects reflecting the number of home buyers and the amount
paid by them.
The amicus curiae is permitted to collect data on a web
portal from flat buyers who are interested in taking possession of
the flats or those who have taken possession. All the home buyers
including those who have already submitted the data are directed to
upload the data on the web portal which shall be created by
Mr.Pawan Shree Agarwal,learned amicus.
Let the matter be listed on 21.09.2017, on which date,
the amicus shall provide the details of the web portal.
Liberty is granted to the petitioners to provide details
to the amicus.
The persons who have given advance for the flats are also
permitted to upload the details on the portal so that the amicus
can collect the data in respect of them under a different category.
The learned amicus, is at liberty to take the assistance
of any two lawyers. This Court shall fix their remuneration in due

Process of Registration of Claim for Refund or Possession
The following points should be noted and acted upon before using this website to register a claim:
- The Buyer would be required to upload an Attested Affidavit of a Notary (on Rs 10 or more stamp paper) stating therein whether he wants “Refund” or “Possession”, also mentioning requisite details of allotment number, project name and amount paid. Any person making an Affidavit on the basis of Power of Attorney (POA) needs to upload the same along with the Affidavit.
- Upload a scanned copy of Letter of Allotment; and if the Flat / Villa / Plot is further resold, also a scanned copy of the “Resale Endorsement” page.
- Upload a scanned copy of the buyer’s Photo ID (any one of the following: Aadhar Card, PAN Card or Passport).
Those buyers who are interested in taking possession of Flat / Villa / Plot on an “As Is Where Is” basis shall mention the same in the remarks column of the application form. Additionally, any buyer who has settled or entered into a MOU with Unitech shall mention the same in the remarks column of the application form.
